A. Your Rights. We (Footage Firm, Inc., the operator of storyblocks.com, videoblocks.com, graphicstock.com, and audioblocks.com) grant you a perpetual, worldwide, limited, non-exclusive, nontransferable right to incorporate the Stock Files you obtain from us into a work you create. You may incorporate our Stock Files or templates incorporating our Stock Files into any project, including feature films, broadcast, commercial, educational, print, multimedia, games, merchandise, and the internet. Once you incorporate a Stock File into your project, you can share your finished project freely, but you may not share the underlying individual Stock File as a standalone file with a third party. (However, you can share the Stock Files with your client or other third party for the limited purpose of getting their help with your specific project, assuming you are adding substantial value to the project apart from the Stock Files. Otherwise, they need their own license.) You also agree to use your best efforts to secure the Stock File from being accessed by a third party as a standalone file, but since that’s not always possible, your inability to prevent copying will not be considered a breach of this License. This is an Individual License (the “License”). Storyblocks Individual License is written for and indemnifies you, the individual person who originally signed up for the account, not the entity, company, or client you work for. This means that the license granted here, which allows you to use Stock Files, does not extend to anyone else at your company or client. B. Our Guarantee. We promise that if you use our Stock Files as described in this License, your use will not infringe on the rights (such as copyrights) of a third party (the “Limited Warranty”). We’ll also put our money where our mouth is. In fact, we will provide you up to $20,000 in indemnification if you incur any direct damages from our breaking this promise. Because that’s a big number, we need to make a few things clear, so here come some capital letters. IN NO EVENT, INCLUDING NEGLIGENCE, SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND. OUR MAXIMUM AGGREGATE LIABILITY FOR ALL BREACHES OF THE LIMITED WARRANTY WILL BE LIMITED TO THE LESSER OF THE ACTUAL, DIRECT DAMAGES SUFFERED BY YOU DIRECTLY ARISING FROM SUCH BREACH AND TWENTY THOUSAND DOLLARS.Note that trademarks, logos, or copyrights depicted within our Stock Files are not covered by this guarantee. For example, if one of our videos depicts someone holding a brand-name beverage, that label may be protected by copyright and trademark law and should be used at your own risk (We wouldn’t want you to think that this License lets you reprint Coca-Cola cans.)

C. Limitations. There are a few other limitations we have put in place to protect our artists and other customers:

You cannot sell, license, or redistribute our Stock Files, nor can you build your own stock media site with our files. You cannot create a trademark or logo based on our Stock Files. You cannot use automation, such as computer scripts, to download or “scrape” high volumes of our Stock Files. Finally, you cannot use the Stock Files to harm minors, to encourage violence, or for an unlawful purpose, such as defamation.
For Stock Files that depict identifiable people (“Models”), you must not depict the Models in a way that a reasonable person would find offensive. Just to be clear, the issue is whether the depiction of the Models themselves is offensive, not whether your project as a whole may be offensive. For example, you could use Stock Files with Models in a documentary about a rare and embarrassing medical condition, but you should not depict the Models in a way that suggests they personally carry the condition, unless our video clip already depicts them that way.
For our audio Stock Files, your license does not restrict your right of public performance, but a cue sheet may be required to satisfy the requirements of Performance Rights Organizations (“PROs”). Also, this License allowed you to use our audio clips in YouTube videos, but since we are not associated with YouTube, we cannot prevent other people from incorrectly claiming that your video violates a copyright.
Some Stock Files may have additional restrictions, such as “editorial use only,” which will be noted in the clip’s details.

D. Other Legal Provisions. This part may not be fun to read, but it’s important nevertheless.

This Agreement will be governed by the laws of the State of Delaware, excluding its body of law relating to conflicts of law and copyright law. If any provision of this Agreement is found invalid, the other provisions will not be affected.
Except for claims brought in small claims court, all disputes about this Agreement will be settled by arbitration pursuant to the rules of the American Arbitration Association (“AAA”), subject to the Federal Arbitration Act. The dispute may be arbitrated either by JAMS or AAA. You are thus GIVING UP YOUR RIGHT TO GO TO COURT to assert or defend your rights EXCEPT for matters that may be taken to small claims court. Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. You are entitled to a FAIR HEARING, BUT the arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.

Fraunhofer FDK AAC Codec Library for Android ("FDK AAC Codec") är programvara som implementerar kodnings- och avkodningsschemat MPEG Advanced Audio Coding ("AAC") för digitalt ljud.Denna FDK AAC Codec-programvara är avsedd att användas på en mängd olika Android-enheter.

AAC:s HE-AAC- och HE-AAC v2-versioner anses i dag vara de effektivaste codecs för allmänt uppfattningsljud.AAC-ELD anses enligt oberoende studier vara den kommunikationscodec med full bandbredd som presterar bäst och är i omfattande bruk.AAC har standardiserats av ISO och IEC som en del av MPEG-specifikationerna.

Patentlicenser för nödvändiga patentanspråk för FDK AAC Codec (inklusive från Fraunhofer) kan hämtas från Via Licensing (www.vialicensing.com) eller enskilt från respektive patentägare för ändamålet att koda eller avkoda bitströmar i produkter som uppfyller MPEG-ljudstandarderna från ISO/IEC.Observera att de flesta tillverkare av Android-enheter redan licensierar dessa patentanspråk genom Via Licensing eller direkt från patentägarna. Därför omfattas FDK AAC Codec-programvaran eventuellt redan av dessa patentlicenser när den används enbart för sådana licensierade ändamål.

När ett program länkas med ett bibliotek, oavsett om det sker statiskt eller med hjälp av ett delat bibliotek, är kombinationen av de två juridiskt sett ett kombinerat verk som härletts från det ursprungliga biblioteket.Den vanliga General Public License tillåter därför sådan länkning endast om hela kombinationen uppfyller dess frihetskriterier.Lesser General Public License tillåter mindre krävande kriterier för länkning av annan kod med biblioteket.

Vi kallar denna licens "Lesser" (mindre) General Public License eftersom den gör mindre för att skydda användarens frihet än vanliga General Public License.Den ger även andra utvecklare av fri programvara mindre fördel gentemot konkurrerande icke-fria program.Dessa nackdelar är anledningen till att vi använder vanliga General Public License för många bibliotek.Lesser-licensen medför dock fördelar undre vissa särskilda omständigheter.

Exempelvis kan det i sällsynta fall finnas ett särskilt behov av att uppmuntra till bredast möjliga användning av ett visst bibliotek så att det blir gällande standard.För att detta ska uppnås måste icke-fria program tillåtas använda biblioteket.Ett vanligare fall är att ett fritt bibliotek fyller samma funktion som populära icke-fria bibliotek.I detta fall finns det inte mycket nytta med att begränsa det fria biblioteket till endast fri programvara. Därför använder vi Lesser General Public License.

I andra fall gör tillåtelse att använda ett visst bibliotek i icke-fria program att fler personer kan använda en stor uppsättning fri programvara.Exempelvis gör tillåtelse att använda GNU C Library i icke-fria program att många fler kan använda hela GNU-operativsystemet samt dess variant, GNU/Linux-operativsystemet.

Lesser General Public License skyddar användarnas frihet mindre, men det ser till att användaren av ett program som är länkat med biblioteket har friheten och möjligheten att köra det programmet med hjälp av en modifierad version av biblioteket.

De exakta allmänna villkoren för kopiering, distribution och modifikation följer nedan.Var uppmärksam på skillnaden mellan ett "verk som bygger på biblioteket" och ett "verk som använder biblioteket".Det tidigare innehåller kod som härrör från biblioteket medan det senare måste kombineras med biblioteket för att kunna köras.

De är utanför dess omfång.Körning av ett program som använder biblioteket är inte begränsad, och utdata från ett sådant program omfattas endast om dess innehåll utgör ett verk baserat på biblioteket (oberoende av användningen av biblioteket i ett verktyg för att skriva det).Huruvida det är sant beror på vad biblioteket gör och vad det program som använder biblioteket gör.

6.Ett program som inte innehåller något derivat av biblioteket men är utformat att fungera med biblioteket genom att kompileras eller länkas med det kallas ett "verk som använder biblioteket".Ett sådant verk är isolerat i sig inte ett härlett verk av biblioteket och är därför utanför denna licens omfång.

Länkning av ett "arbete som använder biblioteket" med biblioteket skapar dock en körbar fil som är ett derivat av biblioteket (eftersom den innehåller delar av biblioteket) snarare än ett "arbete som använder biblioteket".Den körbara filen omfattas därför av denna licens.Avsnitt 6 innehåller villkor för distribution av sådana körbara filer.

När ett "arbete som använder biblioteket" använder material från en huvudfil som ingår i biblioteket kan objektkoden för verket vara ett härlett verk av biblioteket även om källkoden inte är det.Huruvida detta föreligger är särskilt viktigt om verket kan länkas utan biblioteket, eller om verket i sig är ett bibliotek.Tröskeln för huruvida detta gäller är inte exakt definierad i lag.

Om verket är ett derivat av biblioteket kan du annars distribuera objektkoden för verket enligt villkoren i avsnitt 6.Körbara filer som innehåller det verket hör också till avsnitt 6, oavsett huruvida de är länkade direkt med själva biblioteket.

7.Som undantag för avsnitten ovan får du även kombinera eller länka ett "verk som använder biblioteket" med biblioteket i syfte att skapa ett verk som innehåller delar av biblioteket samt distribuera det verket enligt villkor som du själv väljer, under förutsättning att villkoren tillåter modifikation av verket för kundens eget bruk och bakåtkompilering för felsökning av sådana modifikationer.

b.Använda en lämplig delad biblioteksmekanism för länkning med biblioteket.En lämplig mekanism är en som (1) vid körningstiden använder en kopia av biblioteket som redan finns på användarens datorsystem i stället för att kopiera biblioteksfunktioner direkt till den körbara filen och (2) fungerar korrekt med en modifierad version av biblioteket, om användaren installerar en sådan, så länge den modifierade versionen är gränssnittskompatibel med den version som verket skapades med.

c.Tillsammans med verket tillhandahålla ett skriftligt erbjudande som är giltigt i minst tre år om att ge samma användare de material som anges i underavsnitt 6a ovan, mot en avgift som inte överstiger kostnaden för att utföra denna distribution.

d.Om distributionen av verket görs genom erbjudande av åtkomst att kopiera från ett avsett ställe erbjuda likvärdig åtkomst att kopiera ovanstående angivet material från samma ställe.

e.Kontrollera att användaren redan har fått en kopia av dessa material eller att du redan har skickat denna användare en kopia.

För en körbar fil måste den obligatoriska formen av det "verk som använder biblioteket" inkludera eventuella data och verktygsprogram som behövs för att reproducera den körbara filen från det.Som ett särskilt undantag behöver dock de material som ska distribueras inte inkludera något som normalt distribueras (i käll- eller binärform) med de större komponenterna (kompilator, kärna och så vidare) i det operativsystem där den körbara filen körs, såvida inte den komponenten i sig medföljer den körbara filen.

Detta krav kan eventuellt strida mot licensbegränsningarna i andra privatägda bibliotek som normalt inte medföljer operativsystemet.En sådan konflikt innebär att du inte kan använda både dem och biblioteket tillsammans i en körbar fil som du distribuerar.

8.Du får placera biblioteksavsnitt som är ett verk baserat på biblioteket sida vid sida i ett enskilt bibliotek tillsammans med andra biblioteksavsnitt som inte omfattas av denna licens samt distribuera ett sådant kombinerat bibliotek, under förutsättning att den separata distributionen av verket baserat på biblioteket och de andra biblioteksavsnitten i övrigt är tillåten samt att du gör följande två saker:

a.Tillsammans med det kombinerade biblioteket tillhandahåller en kopia av samma verk baserat på biblioteket, ej kombinerat med andra biblioteksavsnitt.Detta måste distribueras enligt villkoren i avsnitten ovan.

b.Tydligt meddela med det kombinerade biblioteket att en del av det är ett verk som bygger på biblioteket samt förklara var man hittar medföljande ej kombinerade form av samma verk.

9.Du får inte kopiera, modifiera, underlicensiera, länka med eller distribuera biblioteket med undantag för vad som uttryckligen anges enligt denna licens.Försök att kopiera, modifiera, underlicensiera, länka med eller distribuera biblioteket är ett brott mot avtalet och häver automatiskt dina rättigheter enligt denna licens.Parter som har fått kopior eller rättigheter från dig enligt denna licens får dock inte sina licenser indragna, förutsatt att de upprätthåller fullständig efterlevnad.
